STIPULATION AND CONSENT ORDER

Pursuant to 8 V.S.A. §§ 11, 12, and 15 the Commissioner of the Vermont Department of Financial Regulation (“DFR”) is charged with administering and enforcing the insurance laws of the State of Vermont, including 8 V.S.A. Chapter 131, which governs the conduct of licensed insurance producers.

 

FINDINGS OF FACT

1. Jillian E. Wood holds Vermont nonresident producer license no. 880741.

2. Jillian E. Wood submitted an application for a nonresident insurance producer license on May 15, 2013.

3. On the application, Ms. Wood answered “no” to the question: “Have you ever been convicted of a crime, had a judgment withheld or deferred, or are you currently charged with committing a crime?”

4. Ms. Wood was convicted of misdemeanor larceny in Cumberland County, North Carolina on October 5, 2006.

 

CONCLUSION OF LAW

5. Ms. Wood provided incorrect, misleading, incomplete or materially untrue information on a license application, in violation of 8 V.S.A. § 4804(a)(1).

 

AGREEMENTS AND STIPULATIONS

6. The parties wish to resolve this matter without administrative or judicial proceedings.

7. The parties agree that this Stipulation and Consent Order represents full and complete resolution of the violations described in paragraph 5.

8. Ms. Wood agrees to pay an administrative penalty to DFR in the amount of $500 no later than 30 days after the last date this Stipulation and Consent Order is signed.

9. In the event Ms. Wood does not pay the administrative penalty within time period described in paragraph 8, the Commissioner may, on request from the Insurance Division of DFR, issue an order suspending or revoking Ms. Wood’s nonresident producer license and imposing additional administrative penalties. DFR’s decision not to exercise this option will not constitute a waiver of the right to exercise it at a later time.

10. This Stipulation and Consent Order will not restrain or limit DFR in responding to and addressing any complaint filed with DFR involving Ms. Wood, and DFR reserves the right to pursue restitution in connection with any complaint filed with DFR.

 

CONSENT

11. The Agreements and Stipulations above are incorporated by reference into this Consent.

12. Ms. Wood understands all terms and her obligations in this Stipulation and Consent Order.

13. Ms. Wood consents to the entry of this Stipulation and Consent Order freely and voluntarily.

14. Ms. Wood knowingly and voluntarily waives any right she may have to administrative or judicial review of these matters resulting from entry or enforcement of this Stipulation and Consent Order.
