STIPULATION AND CONSENT ORDER

Pursuant to 8 V.S.A. §§ 11, 12, and 15 the Commissioner of the Vermont Department of Financial Regulation (“DFR”) is charged with administering and enforcing the insurance laws of the State of Vermont, including 8 V.S.A. Chapter 131, which governs the conduct of license insurance producers.

 

FINDINGS OF FACT

1. William C. Mount holds active Vermont resident producer license No. 579305.

2. Mr. Mount was recently terminated from his appointment with New York Life Insurance Company and affiliated companies for, among other reasons, tracing a customer’s signature on an insurance application.

3. In a letter dated September 2, 2013 and in a meeting with representatives of DFR on June 25, 2014, Mr. Mount admitted to tracing a customer’s signature on an application for insurance.

 

CONCLUSION OF LAW

4. Mr. Mount forged another’s name to an application for insurance, in violation of 8 V.S.A. § 4804(a)(11).

 

AGREEMENTS AND STIPULATIONS

5. The parties wish to resolve this matter without administrative or judicial proceedings.

6. The parties agree that this Stipulation and Consent Order represents full and complete resolution of the alleged violations described in paragraph 4.

7. Mr. Mount agrees to pay an administrative penalty to DFR in the amount of $1,000 no later than 30 days after the last date this Stipulation and Consent Order is signed.

8. In the event Mr. Mount does not pay the administrative penalty within the time period described in paragraph 8, the Commissioner may, on request from the Insurance Division of DFR, issue an order suspending or revoking Mr. Mount’s resident producer license and imposing additional administrative penalties. DFR’s decision not to exercise this option will not constitute a waiver of the right to exercise it at a later time.

9. This Stipulation and Consent Order will not restrain or limit DFR in responding to and addressing any complaint filed with DFR involving Mr. Mount, and DFR reserves the right to pursue restitution in connection with any complaint filed with DFR.

 

CONSENT

10. The Agreements and Stipulations above are incorporated by reference into this Consent.

11. Mr. Mount understands all terms and his obligations in this Stipulation and Consent Order.

12. Mr. Mount consents to the entry of this Stipulation and consent Order freely and voluntarily.

13. Mr. Mount knowingly and voluntarily waives any right he may have to administrative or judicial review of these matters resulting from entry or enforcement of this Stipulation and Consent Order.
